Welcome to The Curious Bonsai (“we,” “us,” “our”). These Terms of Use (“Terms”) govern your use of our website, www.thecuriousbonsai.com.sg (the “Site”), and the services we provide, including psychotherapy, coaching, executive development, workshops, and related offerings (collectively, the “Services”).
By accessing our Site or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Site or Services.
1. No Emergency Services
This Site and our communication channels (including email and messaging apps) are not intended for crisis or emergency care. If you are experiencing a mental health crisis, are at risk of harm to yourself or others, or require immediate medical attention, please contact your local emergency services (e.g., call 995 in Singapore) or go to the nearest hospital emergency department immediately.
2. Nature of Services and Information
2.1 Not a Substitute for Medical Advice: The information on this Site is for informational purposes only and does not constitute medical, psychological, or psychiatric advice. It is not intended to be a substitute for professional advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical or mental health condition.
2.2 No Therapist-Client Relationship from Site Use: Your use of this Site, including reading content or contacting us, does not create a therapist-client or coach-client relationship. Such a relationship is only formed after you have completed our intake process, signed a formal service agreement, and we have explicitly agreed to provide Services to you.
2.3 Advertising and Claims: In line with Singapore’s Healthcare Services Act (HCSA) guidelines for non-licensed providers, our services and any content on this Site are intended to provide support, guidance, and coaching. We do not claim to “treat” or “cure” specific medical or psychiatric conditions. Testimonials and descriptions of our work reflect individual experiences and do not constitute a guarantee of specific outcomes.
3. Fees, Payment, and Cancellation Policy
3.1 Fees: Our current rates for Services will be clearly communicated to you prior to engagement. All fees are stated in Singapore Dollars (SGD) unless otherwise specified.
3.2 Payment: Payment for sessions is required in advance to confirm your booking, unless otherwise agreed in a corporate contract.
3.3 Cancellation and Rescheduling: We require a minimum of 24 hours notice to reschedule or cancel a session without charge. Cancellations or rescheduling requests made within this window will be subject to the full session fee.
3.4 Late Arrivals and No-Shows: If you are late for a session, the session will end at its originally scheduled time. If you do not attend a scheduled session without prior notice (“no-show”), you will be charged the full session fee.
3.5 Packages and Expiry: Service packages must be used within the validity period specified at the time of purchase (e.g., 6 months from the date of purchase). Unused sessions after the expiry date are non-refundable and non-transferable.
3.6 Refunds: Fees for services rendered are non-refundable. Refunds for pre-paid services or packages that have not been rendered will be handled on a case-by-case basis, subject to the terms of your service agreement.
4. Telehealth and Cross-Border Services
4.1 Scope of Services: We provide Services to clients both within and outside of Singapore via telehealth platforms. The availability and nature of these Services may vary by jurisdiction.
4.2 Jurisdictional Limitations: For clients located outside of Singapore, the provision of clinical psychotherapy may be subject to the laws and licensure requirements of your location. Where local law requires a license that our clinician does not hold, our Services will be provided as non-clinical coaching and support only. It is your responsibility to understand and comply with your local regulations.
5. Corporate and Employer-Sponsored Services (EAP)
For Services sponsored by an employer, our commitment to your confidentiality remains paramount. We will not share the content of your sessions with your employer. We may share aggregated, anonymized data (e.g., overall usage rates) or confirmation of attendance for billing purposes, as outlined in the specific agreement with your employer. Exceptions to confidentiality apply where required by law or in cases of imminent risk of harm.
6. Group Offerings (Workshops, Retreats)
6.1 Confidentiality: We require all participants in group settings to respect the confidentiality of others. However, we cannot guarantee the actions of other participants. You agree not to disclose personal information shared by others during a group session.
6.2 Conduct: We reserve the right to remove any participant from a group offering who is disruptive or fails to adhere to the group’s code of conduct, without a refund.
7. Acceptable Use of the Site
You agree not to:
- Use the Site for any unlawful purpose.
- Transmit any material that is harassing, defamatory, or otherwise objectionable.
- Attempt to gain unauthorized access to our systems or engage in any activity that disrupts the Site or Services.
- Engage in data scraping, automated access, security testing, or reverse engineering of the Site.
- Introduce any viruses, trojans, worms, or other malicious code.
8. Intellectual Property and Recordings
8.1 Ownership: All content on this Site, including text, graphics, logos, and materials provided during our Services (handouts, worksheets), is the intellectual property of The Curious Bonsai or its licensors and is protected by copyright law. Psychometric tools (e.g., MBTI®, Hogan®, CliftonStrengths®) are the intellectual property of their respective publishers.
8.2 License: Materials provided to you are for your personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from our materials without our express written permission.
8.3 Recording: Recording of any session (audio or video) by any party is strictly prohibited unless mutually agreed upon in writing beforehand. Any approved recording remains our confidential information and must not be shared.
9. Limitation of Liability and Disclaimers
The Site and Services are provided on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or Services. Our total liability to you for any claim arising out of or relating to these Terms or our Services is limited to the amount you paid us for the Services in the 12 months preceding the claim.
10. Dispute Resolution
These Terms are governed by the laws of the Republic of Singapore. In the event of a dispute, you agree to first attempt to resolve it through good-faith negotiation with us. If negotiation fails, the dispute shall be referred to and finally resolved by mediation at the Singapore Mediation Centre. If mediation fails, the dispute may be resolved in the courts of Singapore, which shall have exclusive jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Site or Services after such changes constitutes your acceptance of the new Terms.
